Frequently Asked Questions

We’ve compiled a list of the questions we get asked most often. To find the answer you’re most interested in, simply click on one of the questions below.

What is Included in the “Maintenance Fee”?

The following items are included:

  1. Public liability and property damage insurance;
  2. Snow removal and general winter maintenance of common areas, including streets, common parking areas, and sidewalks adjacent to roadways;
  3. Maintaining, cleaning, striping, patching and general upkeep of streets, common parking lots and common walkways (but not snow removal of walking paths or individual driveways);
  4. Grass cutting and general lawn and landscaping maintenance of common areas;
  5. Tree maintenance, including pruning, cutting and replacing trees on common areas;
  6. All wages, employee benefits, offices, vehicles, equipment and overhead expenses related to the operation of the Community;
  7. Maintenance and upkeep of storm water management and drainage works; and
  8. Any administrative and supervisory fee of the Community Owner.

How long is the Lease?

Under Ontario law, leases of this nature are not to exceed 21 years less a day. However, at any time or from time to time a Homeowner may request the Community Owner to prepare a new lease that will be for 21 years less a day. There is an administration fee (currently $250.00). The Community Owner is required to provide this new lease. If the Home Owner sells his/her home, the Community Owner is similarly required to accept the new Home Owner by way of an assignment of the balance of the existing lease or enter into a new lease for 21 years less a day with the new Home Owner. The Community Owner may not unreasonably refuse to provide a new lease or accept the assignment of the balance of the existing lease. Any new Home Owner has the same rights as the original Home Owner to request a new lease for 21 years less a day. The Residential Tenancies Act protects Home Owners to ensure that home can be sold and the Home Owners control the process.

What Uses are Permitted for Homes within the Thornbury Meadows Community?

The Home Site and the Home are to be used for residential occupancy of a single family home. There is to be no business operated that would generate traffic or involve storage of materials or equipment. This protects other Home Owners from anything that could reasonably be said to cause a disturbance.

The Home Site and the Home are part of an adult lifestyle community. Generally, this means 55+ years of age and no more than two (2) adults are to be occupants however exceptions can be made to allow one additional person for home care purposes or for the purpose of housing a disabled and dependent adult child.

What can be Stored on the Home Site?

A Home Owner may park up to two (2) licensed automobiles (one in the garage and one in the driveway in front of the garage). These parking spaces may not be sublet to others without the permission of the Community Owner. There are visitor parking areas where visitors may park on a temporary basis.

To maintain the aesthetic appeal of the Community, no storage of material or items is to occur outside the home (and garage). On the back patio Home Owners may have patio tables, chairs, a barbeque, etc. Front and back laws, driveways, walkways and front porches are to have no items stored or placed unless agreed upon by the Community Owner and all Home Owners will be treated in the same fair way.

Are there any Restrictions on the Way in Which a Home Owner Repairs, Maintains or Replaces any Portion of the Home as may be required?

Yes. It is the Home Owner’s responsibility and at its expense to keep the Home and any improvements on the Home Site in a reasonable state of cleanliness and in a good state of repair. The Community Owner has the right to approve the location and appearance of any buildings, additions, fixtures, awnings, patios, decks, landscaping or other changes to the Home Site. Any repairs, maintenance or replacements of the roof or exterior of the Home are to be in accordance with the materials, type, colour and configurations of the homes in the Community so as to maintain the aesthetic appearance of the Community. The Community Owner can require maintenance, repairs and where necessary, replacement where reasonably required.

Can I Have a Pet?

Yes. However, they are to be kept at all times under the Home Owner’s or visitor’s control. When walked, the pet must be on a leash and may not be left alone outside tied, tethered or chained. If a pet is found to be contributing to an unacceptable noise level or displays behaviors that endangers or infringes on the rights of others, the Home Owner will be required to remove the animal from the Community. Service animals have special exemptions.

Are there Rules and Regulations: Guidelines for Community Living?
